1) Acceptance of these Terms
By accessing or using our websites, forms, or services (the “Services”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.
2) Eligibility
You must be at least 18 years old (or the age of majority in your state) and able to form a binding contract to use the Services.
3) SMS/Text Program for Appointment Reminders
- Program description. With your consent, Capstone sends SMS/texts about appointments and related updates.
- Consent. By opting in (e.g., checking a box or submitting your phone number and consenting), you authorize us to send recurring texts to the number you provide using an autodialer or similar technology. Consent is not a condition of purchase.
- Message frequency. Varies by appointment (typically 1–3 per appointment).
- Fees. Message & data rates may apply.
- Opt-out. Reply STOP to cancel. You may also email support@capstonebt.com or call 800-224-0276.
- Help. Reply HELP for help.
- Carrier disclosure. Carriers are not liable for delayed or undelivered messages.
- Your obligations. You represent you are the subscriber or customary user of the number provided and will notify us if you change numbers.
4) Accounts & Information
You’re responsible for maintaining the accuracy of your information and for all activity under your account, if any.
5) Acceptable Use
Do not misuse the Services. Prohibited activities include reverse engineering, interfering with security, scraping without permission, and illegal, infringing, or harmful content.
6) Intellectual Property
The Services and all content are owned by Capstone or its licensors and protected by law. We grant you a limited, revocable, non-transferable right to use the Services for their intended purpose.
7) Third-Party Links & Tools
We may provide links or integrate with third-party tools. We are not responsible for third-party websites, services, or policies.
8) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the Services will be uninterrupted, secure, or error-free.
9) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPSTONE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS OR REVENUES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
10) Indemnification
You agree to indemnify and hold Capstone harmless from claims arising out of your use of the Services or violation of these Terms.
11) Changes to the Services or Terms
We may modify the Services or these Terms at any time. Updates are effective when posted. Continued use after changes means you accept the updated Terms.
12) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of [YOUR STATE], without regard to conflicts rules.
Arbitration & Class-Action Waiver (U.S. users): Any dispute arising out of or relating to the Services will be resolved by binding arbitration on an individual basis; class actions are not permitted. You may pursue a claim in small-claims court if eligible. You can opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@capstonebt.com with subject “Arbitration Opt-Out” and your name and phone number.
13) Termination
We may suspend or terminate your access at any time, including for suspected violations of these Terms. Sections that by nature should survive termination will do so.

This Privacy Policy describes how we collect, use, disclose, and protect information when you interact with our websites, forms, and SMS/text programs (together, the “Services”). This policy applies to U.S. visitors unless otherwise stated.

- You provide: name, email, mobile number, appointment details, preferences, messages you send to us, and other form responses.
- Automatic data: device and browser info, IP address, identifiers (e.g., cookies), pages viewed, and interaction data.
- From others: service providers (e.g., scheduling platforms), carriers, analytics partners, and publicly available sources, as permitted by law.
3) How We Use Information
We use information to:
- Provide and manage appointments and related communications (including SMS reminders).
- Send administrative messages (confirmations, updates, service notices).
- Respond to inquiries and provide support.
- Improve the Services, analytics, and security/fraud prevention.
- Comply with legal obligations and enforce policies.
- With your consent, send marketing (you may opt out at any time).
4) SMS/Text Disclosures

- We may receive delivery/read status and related metadata from carriers and messaging providers.
5) Cookies & Tracking
We use cookies and similar technologies for essential site functions, analytics, and (if enabled) advertising measurement. You can control cookies via browser settings. We respond to “Do Not Track” signals as “not required by law” and may not alter our practices solely due to DNT.
6) Disclosure of Information
We may share information with:
- Service providers/Processors who perform services on our behalf (e.g., scheduling, messaging, analytics, hosting), bound by contract.
- Affiliates under common ownership, consistent with this policy.
- Legal & safety: to comply with law, enforce terms, or protect rights/safety.
- Business transfers: as part of a merger, acquisition, or asset sale.
We do not sell personal information for money. If we engage in cross-context behavioral advertising, we will provide the required opt-out mechanisms.
7) Your Choices
- SMS: Reply STOP to any message, or contact us to opt out or update your number.
- Email: Use unsubscribe links or contact us.
- Cookies: Manage via browser settings; some features may not work without cookies.
- Access/Correction/Deletion: You can request access to or deletion/correction of your information by emailing support@capstonebt.com. Residents of certain U.S. states (e.g., CA, CO, CT, VA) may have additional rights described below.
8) State Privacy Rights (U.S.)
Depending on your state, you may have rights to know/access, correct, delete, and opt out of certain processing. To exercise rights, email support@capstonebt.com with “Privacy Request,” describe your request, and provide information we reasonably need to verify your identity. You will not be discriminated against for exercising your rights. If we deny a request, you may appeal by replying to our decision email with “Appeal.”
9) Data Retention
We retain information as needed to provide the Services and for legitimate business purposes (e.g., records, security, legal), then delete or de-identify it according to our retention practices.
10) Security
We use administrative, technical, and physical safeguards appropriate to the nature of the information. No method of transmission or storage is 100% secure.
11) Children’s Privacy
Our Services are not directed to children under 13, and we do not knowingly collect information from them. If we learn we have information from a child under 13, we will delete it.
12) International Users
Our Services are intended for U.S. users. If you access them from outside the U.S., you consent to processing in the U.S., which may have different data protection laws than your jurisdiction.
13) Changes to this Policy
We may update this Policy from time to time. The “Effective date” above shows when it was last updated. Material changes will be posted on this page and, where required, notified to you.
